Ontario: How to Appeal an ODSP Decision to the Social Benefits Tribunal (SBT)

The Social Benefits Tribunal (SBT) in Ontario hears appeals about social assistance decisions, including ODSP and Ontario Works. This page summarizes what the official SBT website says about who can appeal, which forms to use, and what happens at a hearing.

Who handles this

In Ontario, if you applied for the Ontario Disability Support Program (ODSP) and were refused, or you already receive ODSP and disagree with a decision, you can file an appeal with the Social Benefits Tribunal (SBT). The SBT is an independent tribunal under Tribunals Ontario that hears disputes about social assistance.

This page only restates what the SBT's official website says. It does not offer advice on whether or when to appeal.

When you can appeal to the SBT

The official page states that you can file an appeal with the SBT if:

  • Ontario Works or the Ontario Disability Support Program have refused to pay you social assistance; or
  • you already receive social assistance but disagree with a decision about:
  • your eligibility for assistance;
  • the amount of assistance you receive;
  • the benefits you receive.

The site has a section titled "Before you appeal" covering what you should know before filing and what you need to file. The page does not list the specific items here.

Forms and filing

The SBT site has a section called "Choosing the right forms" where you can find the appeal forms you need and learn how to submit them.

A notice dated January 7, 2026 states that the SBT has updated two forms:

  • the Appeal (Form 1); and
  • the Application for Reconsideration (Form 2).

The update adds the Social Assistance Intake Unit as a Respondent for appeals related to applications for both ODSP and Ontario Works. Part 2 of the Application for Reconsideration (Form 2) now includes Representative Information.

Hearing process

The official page divides hearing information into three parts:

  • How to prepare for your hearing;
  • What to expect at your hearing;
  • What happens after your hearing.

The site also has a section on application and processing timelines at the SBT. Check that section for the specific timeframes.

Early resolution

The site has a section on early resolution, which it says can help you resolve your appeal before a hearing. See the official page for details.

Interim Assistance

Under "Other resources," the site lists Interim Assistance for people experiencing financial hardship. See the official page for eligibility and amounts.

Laws, rules and decisions

The site has a section on the SBT's legislation, regulations and rules.

Tribunals Ontario offers supports and services including:

  • requesting an accommodation (including access to a computer, internet or phone);

The site has a "Contact the SBT" section for contact details. This page does not list a specific address or phone number.
